Terms & Conditions

These Terms and Conditions ("Terms") govern your use of websites, funding-readiness tools, communications, and services provided by SOAR To The Top ("SOAR," "we," "us," or "our"). By using a SOAR page or submitting a request, you agree to these Terms and our Privacy Policy.

Important: SOAR is not a lender. The Funding Readiness Quick Check, Funding Gap Snapshot, and any later analysis are educational and service-screening tools. They are not credit applications, lender decisions, financing offers, legal or tax advice, or guarantees of approval, funding, rates, terms, amounts, timing, or outcomes.

1. Eligibility and authority

You must be at least 18 years old and legally able to agree to these Terms. If you act for a business, you represent that you are authorized to provide its information and request services on its behalf.

2. Funding Readiness Quick Check and free Snapshot

The Quick Check uses information you voluntarily report to produce a preliminary readiness band and facilitate delivery of a free Funding Gap Snapshot. It does not access a consumer report or perform a hard credit inquiry. The 680 readiness gate is SOAR's internal preliminary criterion and is not a lender underwriting standard or approval.

Your result may be incomplete or inaccurate if the information you submit is incomplete, outdated, or incorrect. Credit is only one consideration; revenue, time in business, utilization, obligations, documents, industry, use of funds, geography, lender criteria, and other factors can affect available options.

3. No application or lender relationship

Submitting the Quick Check does not submit an application to a lender, create a lending relationship, reserve capital, or obligate any lender or provider to review or approve a request. If you later choose to consider a third-party product, that provider will use its own application, eligibility, underwriting, disclosures, pricing, privacy terms, and agreements.

4. Later paid services

SOAR may separately offer an analytical or consulting service after delivering the free Snapshot. Any paid service is governed by the description, scope, price, timing, and checkout terms presented when you choose to purchase. Payment for an analysis does not purchase financing and does not guarantee that financing is available or that an application will be approved.

Fees, cancellation rights, and any refund terms displayed at checkout or in an order confirmation form part of these Terms for that purchase. If a checkout-specific term conflicts with these general Terms, the checkout-specific term controls for that purchase. Payment-card information is provided directly to the disclosed payment processor, not through the Quick Check.

5. Your responsibilities

You agree to provide information you reasonably believe is accurate and current; use the services only for lawful business purposes; maintain the security of any credentials or links; review deliverables and third-party documents before acting; and seek appropriate professional advice for legal, tax, accounting, credit, or financial questions.

Do not submit a Social Security number, date of birth, bank login, full bank-account number, payment-card information, or information that you do not have authority to provide through the Quick Check.

6. Communications and consent

When you request an assessment, we may send service communications needed to respond and deliver it. Marketing email or text communications will be sent only as permitted by applicable law and your choices. Consent to marketing texts is not a condition of purchase. Message and data rates may apply.

You may use an email unsubscribe link, reply STOP to a text, or use another reasonable method that clearly communicates an opt-out request. We may send one nonmarketing confirmation of a text opt-out. You remain responsible for keeping your contact information current.

7. Third-party services and links

SOAR uses third-party technology and may provide links to payment processors, service providers, or other businesses. We do not control their availability, security, content, privacy practices, underwriting, pricing, or decisions. A link or introduction does not by itself constitute an endorsement or guarantee.

8. Intellectual property and permitted use

The SOAR name, site design, written content, assessment structure, graphics, and deliverables are owned by SOAR or used with permission and are protected by applicable law. SOAR grants you a limited, nonexclusive, nontransferable right to use a deliverable for your internal business purposes. You may not copy, resell, publish, scrape, reverse engineer, or create derivative commercial products from the services without written permission.

9. Prohibited conduct

You may not use the services to violate law, infringe rights, submit malicious code, interfere with systems, impersonate another person, misrepresent authority, collect information about others without permission, or attempt unauthorized access. We may suspend access when reasonably necessary to protect users, systems, or legal rights.

10. Disclaimers

Services and content are provided on an "as is" and "as available" basis to the fullest extent permitted by law. SOAR does not warrant that a page, communication, or third-party service will be uninterrupted, error-free, or suitable for every purpose. Educational information is general and may not reflect your complete circumstances or current laws, lender policies, or market conditions.

11. Limitation of liability

To the fullest extent permitted by law, SOAR will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, loss of data, or third-party decisions arising from use of the services. Nothing in these Terms excludes or limits liability that applicable law does not permit to be excluded or limited.

12. Changes and termination

We may update these Terms as services or legal requirements change. Revised Terms will be posted with a new effective date. We may discontinue or modify a free service, or restrict use that violates these Terms, subject to obligations governing any paid service already purchased.

13. Severability and entire agreement

If a provision of these Terms is found unenforceable, the remaining provisions will continue to the extent permitted by law. These Terms, the Privacy Policy, and any checkout-specific terms or written service agreement form the entire agreement governing the applicable service.
